Terms and Conditions

1. Introduction

These Terms of Service (AGB) govern the contractual relationship between DigiTales Interactive UG (haftungsbeschränkt) (“DigiTales Interactive” for short, referred to as “we”, “our”, or “us”) and our customers (referred to as “you” or “customer”) for purchases made via our online shop at https://6vcr.com/shop/. By placing an order with us, you agree to these terms.

3. Scope of Application

These Terms of Service apply to all contracts concluded between you and DigiTales Interactive through our online shop. Any differing terms and conditions of the customer will not apply unless explicitly agreed upon in writing.

4. Conclusion of the Contract

4.1. Order Process

  • The presentation of products in our online shop is not a legally binding offer but an invitation to place an order.
  • By clicking “Buy Now”, “Place Order”, or similarly worded buttons, you submit a binding order for the goods in your shopping cart.
  • We will confirm receipt of your order via email. This confirmation does not yet constitute an acceptance of the contract.
  • A purchase contract is only concluded when we expressly accept your order via a second email (order confirmation) or by shipping the goods to you.

4.2. Contract Language

The language available for the conclusion of the contract is English. All customer communication and documentation will also be provided in English.

5. Prices and Payment

5.1. Prices

  • Prices listed on our website do not include VAT until a shipping address is provided. The final price including VAT is then calculated.
  • Shipping costs are also calculated separately and displayed during the checkout process.

5.2. Payment Methods

We offer the following payment methods:

  • Credit Card: Processed through Woocommerce Payments.
  • PayPal: Payments are processed through PayPal.
  • Google Pay: Payments are processed through Google.
  • Apple Pay: Payments are processed through Apple.

Payment is due immediately upon conclusion of the contract unless otherwise agreed upon.

6. Shipping and Delivery

6.1. Delivery Time

  • Delivery times can vary depending on current order load. It can take us up to 3 business days before the order is dispatched. Shipping time depends on the destination and ranges from 1-2 days within Germany to multiple weeks the further away you are from the European Union. Do not forget to check your email (and spam folder) for updates!
  • If the ordered product is not available, we will notify you promptly and may offer a replacement or cancel the contract with a refund.

6.2. Shipping Costs

  • Shipping costs are displayed during checkout. They depend on the delivery location and the weight and dimensions of the goods.
  • Free shipping may be offered for orders above a certain value, as indicated on our website.

6.3. Transfer of Risk

The risk of accidental loss or deterioration of the goods is transferred to the customer when the goods are handed over to the shipping provider, provided the customer is not a consumer.

7. Right of Withdrawal

7.1. Cancellation Policy

Consumers (according to § 13 BGB) have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day you or a third party designated by you, who is not the carrier, takes possession of the goods.

7.2. How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement via email to shop@6vcr.com.

You may use the model withdrawal form below, but it is not mandatory.

7.3. Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for the additional costs arising from choosing a type of delivery other than the least expensive standard delivery offered by us), within 14 days of receiving your withdrawal notice. We will use the same payment method for the reimbursement that you used for the initial transaction unless expressly agreed otherwise.

You must return the goods to us without undue delay and in any case no later than 14 days from the day you communicate your withdrawal. You bear the direct cost of returning the goods.

8. Retention of Title

We retain ownership of the goods until full payment of the purchase price has been received.

9. Liability for Defects

9.1. Warranty

  • The statutory warranty rights for defects apply. The warranty period for goods is two years from the date of delivery.
  • If the delivered goods are defective, you have the right to request replacement. If this fails, you may demand a reduction in price or withdraw from the contract.

9.2. Exclusion of Liability

We are liable for damages only in cases of willful intent, gross negligence, or breach of a major contractual obligation (Kardinalpflichten). In cases of slight negligence, we are only liable for foreseeable damages typical for this type of contract. This limitation does not apply to claims for injury to life, limb, or health.

10. Data Protection

We process personal data in accordance with our Privacy Policy. By placing an order, you agree to the collection and processing of your personal data necessary to fulfill your order.

11. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR), which can be accessed here: https://ec.europa.eu/consumers/odr. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

12.1. Applicable Law

These terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law only applies to the extent that it does not deprive you of the protections provided by mandatory consumer protection laws in the country of your habitual residence.

12.2. Jurisdiction

If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our registered office.

12.3. Severability Clause

If any provision of these Terms of Service is found to be invalid or unenforceable, the remainder of the terms will remain in full force and effect. The invalid provision shall be replaced by a valid one that most closely reflects the economic intent of the original.
